Welcome to Spirit and Fire (“Spirit and Fire,” “we,” “us,” or “our”). We operate this website and online store (the “Services”) to offer you curated Christian apparel and related products. Our store is powered by Shopify, which enables our e-commerce functionality.
These Terms of Service (the “Terms”) govern your access to and use of the Services. By visiting, interacting with, or purchasing from the Services, you agree to these Terms and to our Privacy Policy ([link to your Privacy Policy]). If you do not agree, do not use the Services.
1. ACCESS AND ACCOUNT
You represent you are at least the age of majority in your place of residence and you consent to any minor dependents using the Services on devices you own or manage. You may be asked to provide information (e.g., email, billing, payment, shipping). You warrant all information you provide is accurate, current, and complete and that you have rights to provide it. You are responsible for safeguarding your account credentials and for all activity under your account. You may not transfer, sell, or license your account.
2. OUR PRODUCTS
We strive to display products accurately, but colors and appearance may vary due to device settings. We do not warrant that products will meet your expectations or look identical to on-screen images. Product descriptions and availability may change at any time; we may limit quantities or discontinue products in our discretion.
3. ORDERS
Your order is an offer to buy. We may accept or decline any order in our discretion. Orders are accepted only once payment is processed and we confirm acceptance. Please review your order carefully; cancellations may not be possible after acceptance. If we change or cancel an order, we’ll attempt to notify you at the email, billing address, and/or phone number provided. Your purchases are subject to our Refund/Returns Policy. You represent that purchases are for personal/household use and not for resale or export.
4. PRICES AND BILLING
Prices, discounts, and promotions may change without notice. The price in effect at the time of your order applies and will appear on your confirmation email. Unless stated otherwise, prices exclude taxes, shipping, handling, customs, and import charges. Promotions may have separate terms; if they conflict with these Terms, promotion terms control. You agree to provide accurate payment details and authorize us (and our payment processors) to charge all amounts due, including applicable taxes and shipping.
5. SHIPPING AND DELIVERY
Delivery dates are estimates only and not guaranteed. We are not liable for delays caused by carriers, customs, or events beyond our control. Title and risk of loss pass to you upon our delivery to the carriers
6. INTELLECTUAL PROPERTY
All content on the Services— including text, graphics, logos, images, video, audio, and their selection/arrangement— is owned by Spirit and Fire or its licensors and protected by law. You may use the Services for personal, non-commercial purposes only. You may not copy, modify, distribute, publicly display, or create derivative works without our prior written consent. “Spirit and Fire” names, logos, product names, designs, and slogans are our trademarks. Shopify’s marks are owned by Shopify. Other marks are the property of their respective owners.
7. OPTIONAL TOOLS
We may provide access to third-party tools “as is” and “as available,” without warranties or endorsements. Your use is at your own risk and subject to third-party terms. Future features released through the Services are also subject to these Terms.
8. THIRD-PARTY LINKS
The Services may link to third-party sites or content. We are not responsible for examining or evaluating third-party materials and are not liable for your use of them. Review third-party policies before engaging in any transaction. Any complaints or questions about third-party products or services should be directed to that third party.
9. RELATIONSHIP WITH SHOPIFY
Our store is powered by Shopify. Your purchases are made directly with Spirit and Fire, not Shopify. By using the Services, you acknowledge Shopify is not responsible for your transactions with Spirit and Fire and you release Shopify and its affiliates from claims related to such transactions.
10. PRIVACY
Your use of the Services is subject to our Privacy Policy ([link to your Privacy Policy]). Because our Services are hosted by Shopify, Shopify collects and processes certain personal information in order to operate and improve the Services; see Shopify’s Privacy Policy (https://www.shopify.com/legal/privacy) for details. Information you submit may be processed in countries other than where you reside.
11. FEEDBACK
If you submit reviews, ideas, suggestions, or other content (“Feedback”), you grant us a perpetual, worldwide, royalty-free, sublicensable license to use, reproduce, modify, publish, and display that Feedback for any lawful purpose. You represent you have rights to grant this license and that your Feedback complies with law and these Terms. We may monitor, edit, or remove Feedback we deem unlawful or objectionable, but we have no obligation to do so.
12. ERRORS, INACCURACIES, AND OMISSIONS
Information on the Services may contain errors or omissions (e.g., product descriptions, pricing, availability, shipping charges). We may correct errors, update information, or cancel orders if information is inaccurate at any time without prior notice.
13. PROHIBITED USES
You may not use the Services for unlawful or malicious purposes; to violate regulations; to infringe intellectual property; to harass, defame, or harm others; to transmit misleading information; to upload malware; to spam; to impersonate others; to collect personal information unlawfully; or to interfere with security or operation of the Services. 14. TERMINATION
We may terminate or suspend the Services (or your access) at any time without notice. You remain liable for amounts due up to termination. Sections intended to survive (including IP, Feedback, Warranty Disclaimers, Limitation of Liability, Indemnification, Severability, Governing Law) will continue after termination.
15. DISCLAIMER OF WARRANTIES
Except as expressly stated by Spirit and Fire, the Services and all products are provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, and uninterrupted or error-free operation. Some jurisdictions do not allow certain disclaimers, so some exclusions may not apply.
16. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Spirit and Fire (and our officers, directors, employees, agents, contractors, partners, service providers, and licensors) will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages; or for lost profits, revenues, data, or goodwill arising from or related to the Services or products, even if advised of the possibility. Our total liability for any claim will not exceed the amount you paid for the product giving rise to the claim or one hundred U.S. dollars (US$100), whichever is greater. Some jurisdictions do not allow certain limitations, so some limitations may not apply.
17. INDEMNIFICATION
You agree to indemnify and hold harmless Spirit and Fire and our affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms, violation of law or third-party rights, or misuse of the Services.
18. SEVERABILITY
If any provision of these Terms is unlawful or unenforceable, it will be enforced to the maximum extent permissible and the remainder will remain in full force and effect.
19. WAIVER; ENTIRE AGREEMENT
No waiver of any term is a continuing waiver. These Terms, together with policies referenced herein (including the Privacy Policy and Returns Policy), constitute the entire agreement between you and us regarding the Services and supersede prior agreements.
20. ASSIGNMENT
You may not assign or transfer these Terms without our prior written consent. We may assign or transfer our rights and obligations without consent.
21. GOVERNING LAW; VENUE
These Terms are governed by the laws of the State of Utah, without regard to conflict-of-laws rules. You consent to exclusive jurisdiction and venue in the state and federal courts located in Weber County, Utah for all disputes not subject to arbitration or small-claims exceptions (if applicable by law).
22. HEADINGS
Headings are for convenience only and do not affect interpretation.
23. CHANGES TO TERMS
We may update these Terms by posting a new version on the Services. Material changes will be noted consistent with applicable law. Your continued use after changes are posted constitutes acceptance.
